Daryl Finley, band director, gets one hell of a plea deal

Daryl Finley, the 29 year old band director at Mount Hope High School in Mount Hope, West Virginia has plead guilty to misdemeanor battery.

Originally, Finley was indicted on charges of sexual abuse by a parent, guardian, or custodian. It is alleged that Finley fondled a 17 year old student through her clothing on a school bus en-route to a field trip.

Finley started off facing a maximum of 20 years in prison, and now will only face a maximum of 1 year in county jail. The court will likely provide the provision that the assault was sexual in nature, which MAY actually get him some jail time, but lets not bet on it. Finley remains free on $10,000 bond.

Update -- 07/28/2008
Daryl Finley was sentenced to 12 months in jail, with all but 4 months suspended. Of those 4 months, Finley will be able to serve all but 5 days on house arrest.

The judge determined that Finley's crime was in fact sexually motivated, and required him to register as a sex offender for 10 years.
