James Cunneely, 31 year old former teacher of the year, who taught french and spanish at all levels at Kittatinny Regional High School, in Newton, New Jersey, may be cleared of his charges because of a late-received letter sent by his victim.

Cunneely was supposed to be sentenced to up to 3 years in prison following a guilty plea to second degree sexual assault, in December 2007. He was originally charged with one count of first-degree sexual assault and three counts of third-degree aggravated criminal sexual contact.

The contents of the letter were not disclosed, but it was enough for Cunneely to delay his sentencing so that he could decide whether to continue with his guilty plea or to go to trial based on the new facts in the letter.

Update -- 04/17/2008
Cunneely's sentencing will be delayed no longer. He has been sentenced to 3 years in prison, lifetime supervision, and sex offender registry requirements.
